Re: [emrat:11284] SB-175 Pertains to Motorcyclists, Other "Vulnerable" Road Users

Possibly an unpopular opinion, but my knee-jerk take is that this is a bad idea.   I'm worried by the subjective nature of the language, and also how non-"vulnerable"victims of negligence would feel about this special treatment.   Bottom line, I mistrust special classes.

This bill was approved unanimously this afternoon by the Senate Finance Committee and would increase the penalty on a driver's license from 4 points to 12 points and a year-long suspension, with certain exceptions, for a motorist who causes "serious bodily injury" to such "vulnerable" road users as pedestrians, bicyclists and motorcyclists.

The bill now goes to the Appropriations Committee.  It has already passed the Senate Judiciary Committee.

Here's the summary of the introduced bill:

The bill makes it a class 1 traffic misdemeanor when careless driving of a motor vehicle causes serious bodily injury to a vulnerable road user. The bill allows the court to require the violator to attend a driver improvement course, and to require the violator to perform useful public service. The bill also subjects a violator to a restitution order and a license suspension of one year. However, the department of revenue shall consider whether to issue a restricted license to a person convicted of careless driving of a motor vehicle that causes serious bodily injury to a vulnerable road user if the person is required to drive a motor vehicle to and from his or her place of employment or to perform duties within the course of his or her employment.
