I recall recently reading in one of my MC magazines that there is a national lawsuit by some MC organization challenging states that do not allow free use by MC in HOV lanes.  The suit would award attorney fees to the challenger if they prevail.  Colorado is probably trying to head that result off at the pass.  The trick is some "HOV" lanes are really not HOV, they are HOT lanes, like route 36 and the new west bound lane on I-70.  They fall into a grey area as to whether they are included in the federal HOV law.

The legislators said it was never their intention that motorcyclists be charged for using HOV lanes, and they intend to fix this.

 

Whether they actually can get this done is another matter because other provisions of this bill are contentious.  It's a long, hard road to get a bill passed in Colorado when the Republicans control the Senate and the Democrats control the House.
