If the question mark is due to the fact that people have been doing it for years in California, the answer lies in the statement in the article
"Lane-splitting — a common practice in European nations — has been a fuzzy topic in California. The state has never expressly forbidden or allowed it."
It has never been officially legal in CA, it just has never been explicitly illegal there either, as it is in the rest of the states.
