Description: Revisions to sign regulations in the Denver Zoning Code to ensure compliance with U.S. constitutional and federal case law requirements protecting freedom of speech. Details below. 1. Revisions to Article 13, Division 13.3, Definitions of Words, Terms and Phrases: a. Revise definition of “sign” to remove exemptions for (a) flags, (b) time and temperature devices, (c) national/state/religious/ fraternal or professional symbols or crests, and (d) works of art that do not identify a product. b. Revise definition of “sign, noncommercial” to include political signs. c. Delete separate definition of “sign, political.” 2. Revisions to Article 10, Division 10.10, Signs: a. Add general provision allowing owners of any type of sign to substitute protected noncommercial speech/message on a legal sign that may have been approved/used originally for commercial speech/message. b. Remove reference to and standards for holiday decorations. c. Revise regulations for noncommercial signs on residential properties to allow flags and other noncommercial signs (including political signs) no larger than 15 square feet in area. d. Add new standards for noncommercial flags on nonresidential properties. Clarify regulations for other noncommercial signs on nonresidential properties. The Denver Planning Board will hear and make a recommendation on text amendments to the Denver Zoning Code, together with amendments to related provisions of the Denver Revised Municipal Code, on Wednesday, November 21, 2012. Following the Planning Board’s action, the Land Use, Transportation, and Infrastructure Committee of the Denver City Council is scheduled to consider the same proposed text amendments at their meeting on Tuesday, November 27, 2011 (tentative). A draft of the proposed ordinance, together with CPD’s staff report, will be available in electronic format one week before the scheduled Planning Board hearing date at http://denvergov.org/cpd/Zoning/Rezoning/PendingTextAmendments/tabid/437326/Default.aspx.
